Brazil plastic packaging reverse logistics, Decree 12,688/2025
The 2025 decree sets a plastic-packaging reverse logistics system and a 32% national recovery target for 2026.
Legal and market context
The decree covers manufacturers, importers, distributors, retailers and scheme entities subject to activity-specific provisions and exclusions, including individual and collective models.
Required records and evidence
The national 2026 recovery target is 32%. Recycled-content commencement dates differ by company size and actual applicable packaging category.
Practical controlled workflow
EPRORA can organise material evidence but does not submit SINIR reports or issue recycling credits without a separately authorised service.
2026 recovery target: 32%
Annex I and Article 31 set a 32% national recovery target for 2026 together with regional targets, based on packaging mass placed on the market in the previous fiscal year. Determine proportional responsibility by region; the percentage is neither a fee nor automatic proof of compliance.
Scope and MMA clarification
The corrected MMA Notice 002/2026 explains post-consumer B2C packaging coverage and distinguishes strictly B2B packaging, which remains subject to other environmental rules. This is non-binding guidance; check Article 2, sector exclusions and applicable implementing measures.
